1.1. This website enables the buyer (hereafter referred to as “you”) to order an extensive range of computer hardware goods.

1.2. The terms and conditions as listed below are binding and enforceable against any and all persons who accesses or uses this website (www.clouddistribution.africa), including persons who registers with us. By clicking the button “Register” or “Subscribe” you agree to have read the terms and conditions as well as the privacy policy as set out below.

1.3. Users who are already affiliated with CloudCo (www.cloudco.co.za) will automatically be registered as users of the CloudCo NexusWebsite.

1.4. These Terms and Conditions govern the ordering, sales and deliveries of goods as well as the usage of the site.

1.5. This website can be accessed at www.cloudco.nexus and is owned and operated by CloudCo PTY LTD.

2.1. The terms and Conditions as set out below apply to any and all persons who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (“CPA”).

2.2. Your attention is drawn to these Terms and Conditions because they are carefully curated to protect both user and supplier and should be carefully understood.
2.3. If in any case there are sections of this document that is unclear or users do not understand, it is your responsibility as consumer to contact the CloudCo Nexus Team before you accept the Terms and Conditions to continue using the site.

2.4. Nothing in these Terms and Conditions is intended to unlawfully restrict, limit or to avoid any right or obligation, created for you or Cloud Distribution in terms of the CPA.

3.1. We want you to be fully satisfied with your product (purchased through CloudCo Nexus), if you are not fully satisfied because the product is faulty, we will happily exchange your product for the same or similar product, or with a credit which can be spend on the CloudCo platform. We will under no circumstances refund for any sort of cash.

3.2. If you are unhappy with the purchase, it is your responsibility to exchange the product with us within 7 days of purchase, in line with the CPA, failing to do so will result in no exchange or product.

3.3. Certain parts of this returns policy do not apply to unboxed deals. Unboxed deals are products which have previously been opened and returned, products which is offered at a discounted price because of their packaging which has been damaged, unsealed or missing.

3.4. This returns policy is in no way intended to limit your statutory rights in any way.

3.5. Upon returning your product, you are responsible ensure that the following requirements have been met to ensure a speedy request.

3.6. Package your products safely and securely in the original packaging to best of your ability to ensure the safety of the product during transit.

3.7. Clearly mark your order number and return reference number on the outside of the parcel, preferably not on the original packaging.

3.8. Include all parts and accessories which were included in the original packaging upon receiving your order.

3.9. Failing in meeting all the above requirements may slow down your returns process or may result in the declining of your request altogether.

3.10. CloudCo Nexus will under no circumstance accept returned products if you do not want the product anymore, or you have changed your mind about the product. Returns are only valid if a product is defective.

3.11. In the case that a product is defective, please notify us within 7 days of purchase. Cloud Distribution will then collect the defective product and at your choice repair the product or keep the product and provide you with a credit to use on our platform for a new purchase.

3.12. The following will not be regarded as a defect and will not entitle the buyer to a return.

3.12.1. Wear and tear faults

3.12.2. Damage occurring from negligence, abuse or incorrect use of the product;

3.12.3. Damage occurring from electrical surges or sea air/climate corrosion;

3.12.4. Damage occurring from negligent care of the product.

4.1. All product pricing will be hidden to the public on the CloudCo Nexus site, and a person will not be able to make a purchase unless a person registers with us, they will be able to see the products pricing and purchase.

4.2. To register as a CloudCo Nexus member, you need to provide a unique username and password and provide information to CloudCo Nexus. The unique username and password will then be used to access the CloudCo Nexus Website to purchase goods.

4.3. As signing up to become a member you agree that your unique username and password shall be used for personal use only and you will not disclose that information to any third party.

4.4. The correct username and password need to be entered to access the site, failing in entering the correct username and password would result in denied access.

4.5. You agree that upon entering the correct username and password relating to your account, you will be liable for any orders and payments derived from your account. If you suspect someone else has had access to your account, you need to notify CloudCo Nexus as soon as possible for us to take the correct steps in mitigating any resultant loss or harm.

4.6. Users who access our website agree that they are 18 (eighteen) years of age or older and of full legal capacity. In the case a user is under 18 or not in full capacity to enter a binding agreement, you should use the site with the involvement of a superior, parent or legal guardian. If the superior, parent or legal supervisor gives consent to a minor or person without full capacity, such person agrees to be bound by the Terms and Conditions published by CloudCo Nexus.

5.1. Any user who uses the CloudCo Nexus site acknowledge that stock of all products available for purchase is limited and that pricing of such products may change at any time without notice. CloudCo Nexus will always take reasonable effort to monitor stock levels and ensure that when stock is sold out, the offers thereof are terminated on the website.

5.2. Stock will never be guaranteed. In the case where a product was ordered and the stock thereof was no longer available, CloudCo Nexus will notify you and offer a credit or a product of the same value of which was already paid for.

CloudCo Nexus will from time to time offer certain goods at discounted prices for a temporary time. The temporary time will be announced ahead of time and will have a start and finish date. This will be communicated through with email, social media posts and on the website. Any person who is a registered member can purchase the product within the temporary time. In purchasing the product in the discounted price temporary time, a user will only pay the discounted price. If you would like to purchase the same product out of the discounted temporary time you will have to pay the original full price. If you purchase a discount price item along with a product which is not offered at a discounted rate, you will only receive the discounted product at a discounted rate and pay the original price of the item which is not on discount.
